您好，不好意思，又上來請教關於免費軟體於商業公司裡的使用的合法性
因為公司裡最近在找能取代PhotoSHOP的免費繪圖軟體，以節省購置軟體的費用
在網路上找到不少人推薦的這套GIMP免費的繪圖軟體，雖然知道是GNU授權
但還是想請這邊的專家協助審議在商業公司內使用是否有版權上的疑慮
公司內軟體之使用並不會修改程式或安裝於商品販售，主要為員工內部工作上的使用
請協助確認標榜免費在商業公司內使用之合法性，或推薦其他自由軟體，謝謝各位！

軟體License註明內容：

順便再請教一個問題
之前常會使用到的一套備份系統軟體「Ghost v.11」，這套軟體在網路上我查過
好像沒有購買此版的相關資訊，網路上也很容易下載到，特別查了一下他的License說明有提到
「The Licensed Software and Documentation are deemed to be "commercial computer
software" and "commercial computer software documentation" as defined in FAR
Sections 12.212 and DFARS Section 227.7202.」
但不清楚他所說的算是License是有哪些限制，可以免費在商用的公司裡使用嗎？
雖然知道有類似的免費軟體「再生龍(Clonezilla)」但使用上還是習慣用Ghost
因為這家Symantec主要是賣軟體的公司，所以如果沒有相關授權資訊也沒關係，謝謝您。

1、GIMP是以GPL授權釋出的自由開源軟體，您可以放心的使用在公司資訊系統的建置與應用上！

如同GIMP程式裡的ABOUT資訊所述：「GIMP is free software; you can redistribute it and/or modify it under the terms of the GNU General Public License as published by the Free Software Foundation; either version 2 of the License, or (at your option) any later version.」只要是以符合GPL授權規則的方式來運用它，就可以自由地安裝、修改、重製與散布這套軟體，不論是商業或非商業方面的應用，我個人常年以來也是採用這套軟體來取代PHOTOSHOP的功能，所以這方面是不用擔心的。

2、Symantec Ghost並非自由開源軟體或是免費軟體，理論上、一般使用上還是必須取得其正式授權才能夠合法使用。

根據Symantec Ghost的授權聲明：「The Licensed Software and Documentation are deemed to be "commercial computer software" and "commercial computer software documentation" as defined in FAR Sections 12.212 and DFARS Section 227.7202.」其中FAR是「The Federal Acquisition Regulations(美國聯邦採購規則)」的縮寫，DFAR是「The Defense Federal Acquisition Regulations（美國國防聯邦採購規則）」的縮寫，這兩個法則在12.212與227.7202章節的部份，特別有補充了對商業軟體的保護規定，所以Symantec Ghost的授權聲明才會特別引述出來，強調該軟體在使用上必須先得到合法授權，並在應用上「禁止使用者修改、禁止使用者進行逆向還原工程，禁止其他未經許可試圖取得程式源碼的行為」。

所以雖然長時間來Symantec Ghost因程式檔案微小而在網際網路廣為流傳，但其實本質上還是一個須經事先書面授權才能使用的商業軟體，若是想要完全杜絕誤用的風險的話，可能還是採用國研院國網中心研發，並以自由開源授權方式釋出的CloneZilla再生龍為宜(https://clonezilla.nchc.org.tw/intro/)。
